What Amount of Cash, Currency or Monetary Instruments Can I Bring Into or Take Out of the U.S.?

Call (954) 946-8130 for a free telephone consultation.

There is no limit on the amount of money that can be taken out of or brought into the United States. To avoid having your cash or money seized by U.S. Customs you need to understand the basics. Importantly, if a person or persons traveling together and filing a joint declaration (CBP Form 6059-B) have $10,000 or more in cash,  currency or negotiable monetary instruments, they must fill out a “Report of International Transportation of Currency and Monetary Instruments” FinCEN 105 (former CF 4790). The FinCEN 105 can be obtained prior to traveling or when going through CBP checkpoints.

Please be aware, if persons/family members who constitute a “household” are traveling together and have $10,000 or more between them, they cannot divide the currency between each other to avoid declaring the currency. Customs has recently expanded the concept of what is a “household” to reflect the recent U.S. Supreme Court decision striking down DOMA.

For example, if one person is carrying $5,000 and the other has $6,000, they have a total of $11, 000 in their possession and must report it on a FinCEN 105. If a person or family fails to declare their monetary instruments in amounts of over $10,000, their monetary instrument(s) may be subject to forfeiture. In addition, they may be subject to civil and criminal penalties pursuant to 31 U.S.C. 5324.

Below is a list of International U.S. Airports for passengers arriving or leaving the U.S. If you have had your currency/monetary instruments seized by U.S. Customs and Border Patrol at any of these airports,  our law firm will be able to petition for you to seek the return of your money. We have over 25 years of experience with the procedures and laws applicable to currency seizures.

If your currency has been seized by U.S. Customs when you were arriving or leaving the U.S. we can help you petition for the return of your money.  We have 25 years of experience in filing petitions with US Customs & Border Protection seeking the return of  seized currency. We may be able to offer you an attorney fee arrangement based on a combination of a fixed initial retainer and contingency payment based on results achieved.
